Terms of Service

Profica Creator is operated by Jacob Cottam, a sole proprietor based in Veyo, Utah, United States. References to “we”, “our”, or “us” in these Terms mean Jacob Cottam operating Profica Creator.

By accessing or using Profica Creator at https://www.proficacreator.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not access or use the Service.

You must be at least 18 years old to use Profica Creator. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement. The Service is not directed to or intended for use by minors.

Profica Creator is an early-release web application for adults that helps creators draft hooks, outlines, captions, and hashtags and generate short-form vertical videos with AI-generated visuals, narration, and timed captions. Generated videos can be reviewed in a private library and downloaded.

The current Service does not automatically schedule or publish content to TikTok or other social networks and does not provide social-platform analytics. You remain responsible for reviewing, downloading, and publishing any output.

Access to the Service requires you to create an account using an email address via a magic-link sign-in flow powered by Supabase authentication infrastructure. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

You must notify us immediately if you suspect any unauthorised access to your account. We are not liable for losses arising from unauthorised use of your credentials.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
• Use automated scripts, bots, or scraping tools to extract content or data from the Service without our prior written consent.
• Transmit harmful, abusive, defamatory, or otherwise objectionable content through the Service.
• Generate or publish content that infringes intellectual property, privacy, publicity, or other rights, or that deceptively portrays a real person without the permissions and disclosures required by law or the destination platform.
• Interfere with or disrupt the integrity or performance of the Service or its related systems.
• Misrepresent your identity or affiliation in connection with the Service.

All content, branding, software, and materials comprising the Service — excluding content you create or input — are the property of Profica Creator or its licensors and are protected by applicable intellectual property laws.

You retain ownership of any content you provide to the Service. By submitting content, you grant us and our service providers a limited, non-exclusive licence to process that content and generated media only as needed to operate, secure, support, and improve the Service. Your rights in generated output may depend on applicable law and third-party provider terms; we do not guarantee that output is unique or eligible for intellectual-property protection.

Nothing in these Terms transfers any intellectual property rights to you beyond the limited right to access and use the Service as described here.

The Service relies on third-party infrastructure and AI providers, including Supabase for authentication, database, and private media storage; Vercel for the web application; Render for private video processing; Runway for video visuals; ElevenLabs for narration; and an AI text provider for content drafts. Those services are subject to their respective terms, policies, availability, safety systems, and usage limits.

Provider failures, moderation decisions, delays, or limits may prevent generation and may still create third-party infrastructure cost. Under a paid plan, Profica video credits reserved for a request are returned when the job reaches a failed or cancelled state without a usable output.

We are not responsible for the availability, accuracy, or practices of any third-party service.

Creator Launch costs $29 per month and includes six video credits per billing period. A 15-second video uses one credit, a 30-second video uses two credits, and a 60-second video uses four credits. Credits are reserved when generation starts and are consumed when a usable video succeeds.

Unused monthly credits expire at the end of their billing period and do not roll over. Failed or cancelled jobs return their reserved Profica credits unless a usable output was delivered. Plans, allowances, and prices may change prospectively with reasonable notice.

Subscriptions renew monthly until cancelled. You can manage or cancel through the Stripe-hosted customer portal; cancellation takes effect at the end of the current paid period. Except where required by law, fees already paid are non-refundable. Stripe processes payment details under its own terms and privacy policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

AI-generated content produced by the Service is provided as a creative starting point only. You are solely responsible for reviewing, editing, and verifying any content before publishing or using it, confirming you have all necessary rights, and making any legally or platform-required AI disclosures. Outputs may be inaccurate, offensive, similar to other outputs, or unsuitable for your intended use.

The private library is a workflow convenience, not a guaranteed archival or backup service. Download and retain copies of media you need. We may impose generation, storage, or usage limits to protect the Service and control abuse or cost.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PROFICA CREATOR AND ITS OPERATORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may cease using the Service at any time. Self-service account deletion is not currently available. To request account and associated-data deletion, email proficacreator@gmail.com from the email address associated with your account.

On termination, your right to access the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and dispute resolution — will continue to apply.

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If the changes are material, we will make reasonable efforts to notify you.
